In this article, we consider whether personal relationships ca
n affect the way that judges decide cases. To do so, we leverage
the natural experiment of a child’s gender to identify the effect of having daughters on the votes of judges. Using new data on
the family lives of U.S. Courts of Appeals judges, we find that, conditional on the number of children a judge has, judges with
daughters consistently vote in a more feminist fashion on gender issues than judges who have only sons. This result survives a
number of robustness tests and appears to be driven primarily by Republican judges. More broadly, this result demonstrates
that personal experiences influence how judges make decisions, and this is the first article to show that empathy may indeed
be a component in how judges decide cases.

The study finds, for example, that African Americans are 42 percentage points less likely to receive a high rating from the ABA than are whites trained at similarly ranked law schools, with similar legal experience, and nominated by the same president. Women, likewise, are 19 percentage points less likely to be highly rated than men with comparable educational and professional qualifications.
“It is important to have the voices of women and minorities in the federal courts,” says authorMaya Sen, an assistant professor of political science at the University of Rochester. “We know that women and minority judges vote differently once they are on the bench. Women judges tend to be a little more liberal when it comes to sex discrimination cases and African American judges tend to vote a little bit differently when it comes to issues involving civil rights or affirmative action.”
“The record numbers of minority and women nominees currently having judicial candidacies derailed by this vetting process makes this a particularly pressing issue,” she writes in the paper published February 27, in the Journal of Law and Courts.
Creating federal courts that are more reflective of the U.S. population has eluded presidents and advocacy groups for decades. Of the 874 federal judges in service as of 2008, only 24 percent were women, 10 percent African American, 7 percent Hispanic, and less than 1 percent Asian American. Surprisingly, no federal judges in 2008 identified as Native American, despite the court’s involvement in interpreting federal Indian laws, writes Sen.
Many factors can affect a judicial nomination, but the analysis documents that the ABA ratings are one of the most significant. “Receiving a rating of ‘not qualified’ is more or less the equivalent of an ‘F’,” says Sen. Those candidates are 35 percentage points less likely to be confirmed than their more highly-ranked peers, according to the study. During the Obama administration, of the 14 judicial nominees who were given a “not qualified” rating, nine were women and eight were racial or ethnic minorities, Sen reports.
“A judge who receives the ‘F’ is actually no more likely to be reversed than a judge who receives the ‘A+’ rating of well qualified,” says Sen.
The findings call into question the underlying validity of the ratings and raise issues about why presidential administrations defer to the ABA at all. Sen speculates that the legal industry’s weight as a political contributor and ally may, in the end, be more important than its ability to divine judicial performance. As the third-largest source of campaign and political contributions, with donations estimated as high as $390 million in 2008, the ABA represents a “wealthy and giving constituency,” Sen writes. “[I]t makes sense that political actors continue to seek out ABA ratings.”

A notable exception to the low representation of women on judiciaries is the Eastern Caribbean Supreme Court—the highest court for nine countries, including Antigua and Barbuda, Grenada and Saint Kitts and Nevis. Over 60 percent of judges on this court are women.
In terms of gender parity, courts in Latin America and the Caribbean rank second in the developing world. [See Table 2] According to the 2011–2012 UN Women report Progress of the World’s Women, Central and Eastern Europe and Central Asian countries have the most women judges in the world—over 40 percent.1
Even in the U.S., progress toward equality on the courts has been slow. While women occupied approximately 20 percent of all federal judge seats in the U.S. a decade ago, they fill only about 30 percent of such seats today. [See Table 3] Although the Canadian Supreme Court, in which four of nine judges are women, is touted as the world’s first gender-balanced national high court, women comprise about only 32 percent of all judges in Canada’s lower courts.
More troubling still: in some countries the share of women judges has actually decreased over time. Take Guatemala, where women constituted 15 percent of judges on the highest court in 2009, but only 8 percent in 2010. In Panama, women constituted 11 percent of judges (one of nine) on the highest court in 2009, but were entirely absent from the court in 2010. The precise reason for this is unclear, but women were not appointed to fill seats vacated by women judges. In Panama, for example, the Supreme Court’s nine justices each serve a term of only 10 years, so there is fairly frequent turnover and an increased possibility of losing women on the bench.
Getting Into the Club
Across the globe, women judges report that an “old boys’ club” mentality surrounding judicial appointments poses a crucial barrier to entry in the legal profession, particularly in the higher courts.
In the vast majority of cases, judges are appointed by the executive or legislature, sometimes upon the recommendation of commissions—which puts a premium on political connections. Women are typically less connected to these appointment and selection mechanisms than are their male colleagues. In some countries, depending on the level of the court, judges are selected by merit, on the basis of performance on exams. In courts where exams are used to select judges, women tend to be represented in higher numbers. In one such country, France, over 50 percent of the judges are women.
A U.S. survey conducted in the early 1990s by the Task Force on Gender Bias for the Federal Court of Appeals for the Ninth Circuit found that men and women judges and lawyers in the U.S. have different perceptions about gender bias.2 Female judges and lawyers believed that women are excluded from formal and informal networks that influence judicial selection, while male judges and lawyers generally believed that the gender composition of the judiciary was a consequence of merit-based decision-making. Similarly, a 2006 survey of 239 judges in Texas found that 27 percent of women judges believed women had a more difficult time than men in becoming a judge, while only 17 percent of the male judge respondents thought that was the case.3

Over the past three decades, an increasing number of women have joined the legal profession. Since 1992, women’s representation in law school classes has approached 50%. Despite record numbers of female judicial nominees and confirmations, the percentage of female federal judges, however, is far lower. It is of critical importance to increase the representation of women on the federal bench.
When women are fairly represented on our federal courts, those courts are more reflective of the diverse population of this nation and women, and men, may have more confidence that the court understands the real-world implications of its rulings. The increased presence of women on the bench improves the quality of justice: women judges can bring an understanding of the impact of the law on the lives of women and girls to the bench, and enrich courts’ understanding of how best to realize the intended purpose and effect of the law that the courts are charged with applying. For example, one recent study demonstrated that male federal appellate court judges are less likely to rule against plaintiffs bringing claims of sex discrimination, if a female judge is on the panel.
President Obama has appointed 138 female judges – more than any President to date. But to obtain true gender diversity, the number of women in the federal judiciary, including the Supreme Court, must be increased.
Upon the confirmation of Associate Justice Elena Kagan in 2010, the Supreme Court counts three women among its nine Justices for the first time in history, still only one-third of the members of that Court. Only four of the 112 Justices ever to serve on the highest court in the land have been women.
Sixty of the 167 active judges currently sitting on the thirteen federal courts of appeal are female (36%). When broken down by circuit, women’s representation on several of these individual courts is even lower than on the courts of appeals overall:
In particular, women are underrepresented on the Third Circuit (where they make up about 15% of judges) the Eighth Circuit (20%) and the Tenth Circuit (25%).
Thirty-three percent of active United States district (or trial) court judges are women.
There are still 6 district courts around the country where there has never been a female judge.
There are 4 district courts that have had a female judge, but do not currently have one.
For women of color, the numbers are even smaller.
There are 83 women of color serving as active federal judges across the country (only 10.5%) including 43 African-American women, 26 Hispanic women, 11 Asian-American women, one Native American woman, one woman of Hispanic and Asian descent, and one woman of Hispanic and African-American descent.
There are only 12 women of color on the U.S. courts of appeals (7%). Five of those women sit on the Ninth Circuit Court of Appeals, two sit on the DC Circuit, and one woman of color sits on each of the First, Fourth, Sixth, Seventh Circuits and Federal Circuit. Therefore, there are seven federal courts of appeals without a single active minority woman judge.
By the nominations he has made, President Obama has taken an important step towards increasing the representation of women, including women of color, on the bench. He has nominated 171 women to fill federal judicial vacancies and 46% of his nominees to the federal Courts of Appeals have been women. He successfully appointed 7 women to federal Courts of Appeals and 17 women to District Courts where no female judges had previously served. In addition, he has appointed more than twice the number of women of color to the federal bench than any previous President, many of whom have similarly broken barriers on the courts on which they now sit.
During the time remaining in his term, President Obama will have further opportunities to ensure that women are fairly represented in federal courts. In addition to the current vacancy on the Supreme Court, there are 92 vacancies on the federal district and appellate courts. There are two vacancies on the District Court for the Middle District of Alabama and one vacancy on the District Court for the District of Idaho, two district courts where there has never been a female judge.
Additionally, 27 of the vacancies are for seats formerly held by female judges; therefore nominating (and confirming) fewer than 27 more women will result in a net decrease in women on the bench. It is of critical importance for the President to nominate individuals who will add gender and racial diversity to the federal bench, and for the Senate to expeditiously process those nominations, in order to improve access to, and the quality of, justice for all those who turn to our federal courts.

Loreen Olson earned her Ph.D. from the University of Nebraska-Lincoln. She was a member of faculty at the University of Minnesota, Morris, Cleveland State University, and the University of Missouri before joining the UNCG community. Currently, she serves as the Director of the Program to Advance Community Responses to Violence Against Women and the Violence Prevention Network of Guilford County in the Center for Women’s Health and Wellness here at UNCG. Her research addresses communication issues related to gender, family, intimate partner violence, the dark side of close relationships, the communication of deviance, and the luring communication of child sexual predators. Currently, she and her colleagues are examining the relationships between intimate partner violence and traumatic brain injury and polyvictimization and teen parenting. Here at UNCG, Olson teaches gender communication classes cross-listed with WGS in addition to other courses on family communication, communication theory, and the dark side of relational communication. Olson is a past chair of the Family Communication Division of the National Communication Association and editor of the Journal of Family Communication. The current law in the Netherlands gives people more freedom: upon marriage within the Netherlands, both partners default to keeping their own surnames, but both are given the choice of using their partner’s surname, or a combination of the two.
